Notificaci\u00f3n de la deuda al empleado<\/b><span style=\"font-weight: 400;\">: El empleado recibe un aviso de pago.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>2. Orden de embargo<\/b><span style=\"font-weight: 400;\">: Si el empleado no paga, un juez o un organismo p\u00fablico dicta una orden de embargo.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>3. La entidad acreedora emite una notificaci\u00f3n,<\/b><span style=\"font-weight: 400;\"> con la necesidad del embargo de n\u00f3mina.<\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">En la notificaci\u00f3n ser\u00e1 necesario que la entidad determine la cuant\u00eda a embargar, el n\u00famero de cuenta al que se debe hacer el ingreso, el concepto y el procedimiento.<\/p>\n<p style=\"text-align: justify;\"><b>4. Notificaci\u00f3n a la persona deudora<\/b>: La empresa notifica a la persona deudora de la situaci\u00f3n. Entonces esta persona tendr\u00e1 dos opciones:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Pagar el total de la deuda para liquidarla.<br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">O pedir que se embargue su n\u00f3mina para ir pagando una parte de la deuda cada mes.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><b>5. Embargo de la n\u00f3mina<\/b><span style=\"font-weight: 400;\">: En el caso de que la persona deudora decida que la empresa le embargue la n\u00f3mina, se retendr\u00e1 de su salario una cuant\u00eda correspondiente a ese embargo y se transferir\u00e1 a la cuenta del acreedor.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>6. Notificaci\u00f3n para a indicar el levantamiento de embargo:<\/b><span style=\"font-weight: 400;\"> Una vez se haya <strong>pagado el total de la deuda<\/strong>, se emitir\u00e1 una est\u00e1 <\/span><b>obligada a contestar e indicar cu\u00e1l es el salario <\/b><span style=\"font-weight: 400;\">que percibe.<\/span><\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row style=\"text-align: justify;\">Existe una excepci\u00f3n, en el caso de que el sueldo mensual del empleado sea igual o menor al Salario m\u00ednimo Interprofesional, no se podr\u00e1 realizar ning\u00fan tipo de embargo de n\u00f3mina.<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">En el caso de que el sueldo sea superior al SMI, existen diferentes tramos embargables. Tramos que est\u00e1n recogidos en el <\/span><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2000-323\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">art\u00edculo 607 de la Ley de Enjuiciamiento Civil<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Primer tramo, <\/span><b>igual al SMI<\/b><span style=\"font-weight: 400;\">. No es posible embargar nada.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Segundo tramo, <strong>hasta el doble del SMI<\/strong>. Se puede embargar el 30% de la n\u00f3mina.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Tercer tramo, <strong>hasta el triple del SMI<\/strong>. Se puede embargar el 50% de la n\u00f3mina.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Cuarto tramo, <strong>hasta el cu\u00e1druple del SMI<\/strong>. Se puede embargar el 60% de la n\u00f3mina.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Quinto tramo, <strong>hasta el qu\u00edntuple del SMI<\/strong>. Se puede embargar el 75% de la n\u00f3mina.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Sexto tramo, <strong>cualquier cuant\u00eda superior.<\/strong> Se puede embargar hasta el 90% de la n\u00f3mina.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Una misma n\u00f3mina puede recibir varios embargos siempre que no se superen los l\u00edmites
