Seg\u00fan el Tribunal Supremo depender\u00e1 de las obligaciones que tenga el trabajador y si puede o no desconectar, durante este tiempo de pausa.\u00a0<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La reciente <\/span><a href=\"https:\/\/www.boe.es\/biblioteca_juridica\/anuarios_derecho\/articulo.php?id=ANU-L-2025-00000003103\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Sentencia del Tribunal Supremo 808\/2025, de 23 de septiembre<\/span><\/a><span style=\"font-weight: 400;\">, confirma que la organizaci\u00f3n pr\u00e1ctica del servicio es lo que determina si la comida es descanso o tiempo a disposici\u00f3n. La pausa solo se entiende como no retribuida cuando el trabajador puede desconectar sin restricciones. Solo cuando la empresa garantiza una desconexi\u00f3n total y real:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">El trabajador puede apagar comunicaciones o no estar localizable,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Dispone libremente de ese tiempo,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">No se le puede exigir atender avisos durante la pausa.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pausa de comida = tiempo de presencia retribuido<\/b><span style=\"font-weight: 400;\">. Siempre que la desconexi\u00f3n no sea completa o exista la expectativa de ser llamado, aunque el trabajador no est\u00e9 realizando trabajo efectivo. En ese caso, el tiempo debe pagarse conforme al convenio (como presencia o similar).<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La <\/span><b>empresa puede reorganizar el servicio<\/b><span style=\"font-weight: 400;\"> y pasar de un modelo \u00absiempre localizable\u00bb a un modelo \u00abpausa real sin conexi\u00f3n\u00bb, siempre que lo haga por los cauces del <\/span><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">art. 41 del Estatuto de los Trabajadores<\/span><\/a><span style=\"font-weight: 400;\"> (ET), negociando y justificando la medida.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Si la <\/span><b>empresa dice que la pausa es descanso<\/b><span style=\"font-weight: 400;\">, <\/span><b>pero en la pr\u00e1ctica el trabajador no puede desconectar del todo,<\/b><span style=\"font-weight: 400;\"> el riesgo es claro: un juez puede calificar ese tiempo como presencia retribuida con reclamaci\u00f3n retroactiva de 400;\">seguridad privada,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">transporte y log\u00edstica,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">guardias t\u00e9cnicas o de mantenimiento,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">cualquier puesto en el que el trabajador \u00abest\u00e9 de guardia\u00bb durante parte de la jornada.<\/span><\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column basta con llamar \u00abdescanso\u00bb a la pausa<\/b><span style=\"font-weight: 400;\">, <\/span><b>la pausa tiene que parecer y serlo<\/b><span style=\"font-weight: 400;\">. Para que una asesor\u00eda o empresa pueda defender que la hora de comida es descanso de verdad, conviene:<\/span><\/p>\n<p><b>Protocolo por escrito<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Instrucciones claras sobre apagado o desconexi\u00f3n de dispositivos.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Indicaci\u00f3n expresa de que durante ese periodo no est\u00e1n a disposici\u00f3n de la empresa.<\/span><\/li>\n<\/ul>\n<p><b>Coherencia operativa<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Que no haya instrucciones contradictorias del tipo \u00abest\u00e1s de descanso, pero si te llamo, coge\u00bb.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Si por necesidad del servicio se interrumpe el descanso, esa interrupci\u00f3n debe tratarse como tiempo a disposici\u00f3n retribuido.<\/span><\/li>\n<\/ul>\n<p><b>Prueba documental<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Comunicaciones a la plantilla, correos, protocolos internos, acuerdos con el cliente principal (en caso de contratas).<\/span><\/li>\n<li
