clara y pr\u00e1ctica en qu\u00e9 consiste el plan, qu\u00e9 empresas est\u00e1n obligadas y las posibles sanciones por no cumplirlo.<\/span><\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row style=\"font-weight: 400;\">El <\/span><b>Plan o Protocolo LGTBI<\/b><span style=\"font-weight: 400;\"> es un conjunto de medidas y protocolos internos para conseguir la igualdad real y efectiva de las personas LGTBI, que incluya:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Garantizar la igualdad y no discriminaci\u00f3n<\/b><span style=\"font-weight: 400;\"> de las personas LGTBI en el entorno laboral.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Prevenir y actuar ante situaciones de acoso o discriminaci\u00f3n<\/b><span style=\"font-weight: 400;\"> por orientaci\u00f3n sexual, identidad o expresi\u00f3n de g\u00e9nero.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Fomentar un ambiente<\/b><span style=\"font-weight: 400;\"> inclusivo y respetuoso.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La finalidad es que sea un documento que sirva de herramienta pr\u00e1ctica de gesti\u00f3n interna, similar al <\/span><b>Plan de Igualdad de g\u00e9nero<\/b><span style=\"font-weight: 400;\">, pero style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Todas las <\/span><b>empresas con m\u00e1s de 50 personas trabajadoras<\/b><span style=\"font-weight: 400;\"> seg\u00fan el <\/span><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2023-5366\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Art. 60.2 de la Ley 4\/2023<\/span><\/a><span style=\"font-weight: 400;\">. Tanto sean empresas privadas y p\u00fablicas, y se copta el n\u00famero total de personas en plantilla, independientemente del tipo de contrato.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Las <\/span><b>empresas de menos de 50 trabajadores no est\u00e1n obligadas por ley<\/b><span style=\"font-weight: 400;\">, pero pueden adoptar voluntariamente, lo cual puede mejorar su imagen, reputaci\u00f3n y puntuaci\u00f3n en licitaciones p\u00fablicas.<\/span><\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La <\/span><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2023-5366\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ley 4\/2023<\/span><\/a><span style=\"font-weight: 400;\"> recoge en su art\u00edculo 15 la necesidad de que las empresas de m\u00e1s de 50 personas trabajadoras cuenten con un conjunto planificado de <\/span><b>medidas y recursos para garantizar la igualdad real y efectiva de las personas LGTBI<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">El <\/span><b>Plan de LGTBI <\/b><span style=\"font-weight: 400;\">tendr\u00e1 que incluir las siguientes medidas:<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Cl\u00e1usulas de igualdad de trato y no discriminaci\u00f3n<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Medidas que contribuyan a crear un contexto favorable a la diversidad y avanzar en la erradicaci\u00f3n de la discriminaci\u00f3n de las personas LGTBI, con referencia expr\u00e9s a la orientaci\u00f3n e identidad sexual, expresi\u00f3n de g\u00e9nero y caracter\u00edsticas sexuales.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Acceso al empleo<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Las empresas tendr\u00e1n que implementar medidas para erradicar estereotipos en el acceso a la ocupaci\u00f3n de las personas LGTBI. Esto implica una formaci\u00f3n adecuada para quienes participan en los procesos de selecci\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Ser\u00e1 necesario establecer criterios claros que prioricen la idoneidad de la persona para el puesto de trabajo, independientemente de su orientaci\u00f3n e identidad sexual o su expresi\u00f3n de g\u00e9nero, con especial atenci\u00f3n a las personas trans como colectivo especialmente vulnerable.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Clasificaci\u00f3n y promoci\u00f3n profesional<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Los convenios y acuerdos de empresa regular\u00e1n los criterios para la clasificaci\u00f3n, promoci\u00f3n profesional y ascensos, asegurando que no haya discriminaci\u00f3n directa o indirecta hacia las personas LGTBI.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Las decisiones se basar\u00e1n en elementos objetivos, como la calificaci\u00f3n y capacidad, garantizando el desarrollo profesional en igualdad de condiciones.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Formaci\u00f3n, sensibilizaci\u00f3n y lenguaje<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Las empresas incluir\u00e1n en sus planes de formaci\u00f3n m\u00f3dulos espec\u00edficos sobre los derechos de las personas LGTBI en el \u00e1mbito laboral, enfoc\u00e1ndose en la igualdad de trato y la no discriminaci\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Entornos laborales diversos, seguros e inclusivos<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Se promover\u00e1 la diversidad en las plantillas para crear entornos laborales inclusivos y seguros, garantizando protecci\u00f3n contra comportamientos LGTBI-f\u00f3bicos, especialmente a trav\u00e9s de protocolos contra el acoso y la violencia en el trabajo.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Permisos y beneficios sociales<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Es obligatorio garantizar el acceso a los permisos, beneficios sociales y derechos sin discriminaci\u00f3n por raz\u00f3n de orientaci\u00f3n e identidad sexual y expresi\u00f3n de g\u00e9nero, as\u00ed como el goce en igualdad de condiciones de los permisos para consultas m\u00e9dicas o tr\u00e1mites legales, con especial atenci\u00f3n a las personas trans.<\/span><\/p>\n<p style=\"text-align: justify;\"><b>R\u00e9gimen disciplinario<\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Se integrar\u00e1n infracciones y sanciones en el r\u00e9gimen disciplinario de los convenios colectivos por comportamientos que atenten contra la libertad sexual, orientaci\u00f3n e identidad sexual y expresi\u00f3n de g\u00e9nero de los
