Se considera que existe un ERE cuando la extinci\u00f3n afecta al menos a:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">10 trabajadores, en empresas con menos de 100 trabajadores.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">10% de la plantilla en empresas que ocupen entre 100 y 300 trabajadores.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">30 trabajadores en las empresas con m\u00e1s de 300 trabajadores.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfPor qu\u00e9 se puede producir un ERE?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Las causas por las cuales se puede producir un ERE, se regulan en el art\u00edculo 51 del Estatuto de los Trabajadores, y son las siguientes:<\/p>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><strong>Econ\u00f3micas<\/strong>. Existen cuando de los resultados de la empresa se puede ver qu\u00e9 que hay una situaci\u00f3n econ\u00f3mica negativa de la empresa: p\u00e9rdidas actuales, previsi\u00f3n de p\u00e9rdidas o reducci\u00f3n persistente del nivel de ingresos ordinarios o ventas. Se considera que existe una reducci\u00f3n persistente si durante tres trimestres consecutivos el nivel de ingresos ordinarios o ventas de cada trimestre es inferior al del mismo trimestre del a\u00f1o anterior.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>T\u00e9cnicas<\/strong>. Cuando se producen cambios en los medios de producci\u00f3n.<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><strong>Organizativas<\/strong>. Cuando se producen cambios en los m\u00e9todos de trabajo o en la manera de organizar la producci\u00f3n.<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><strong>Productivas<\/strong>. Cuando los cambios se dan en la demanda de los productos o servicios que la empresa quiere vender en el mercado.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfCu\u00e1les son las alternativas a los ERE?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">El Estatuto de los Trabajadores no solo contempla el caso del despido colectivo o ERE para la adecuaci\u00f3n de la plantilla sino que tambi\u00e9n regula las modificaciones sustanciales de las condiciones de trabajo y los ERE temporales.<\/p>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\">Las <strong>modificaciones sustanciales de las condiciones de trabajo<\/strong> se regulan en el art\u00edculo 41 y se pueden utilizar por la direcci\u00f3n de la empresa cuando existan razones econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n que est\u00e9n relacionadas con la competitividad, la productividad o la organizaci\u00f3n t\u00e9cnica o del trabajo en la empresa. Se consideran modificaciones sustanciales de las condiciones de trabajo las que afectan a:\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\">La jornada de trabajo<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\">El horario y la distribuci\u00f3n del tiempo de trabajo<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\">El r\u00e9gimen de trabajo a turnos<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\">El sistema de remuneraci\u00f3n y cuant\u00eda salarial<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\">El sistema de trabajo y rendimiento<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Las funciones<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Por otro lado, otra medida que tambi\u00e9n se contempla en el Estatuto de los Trabajadores y que tambi\u00e9n se puede utilizar para la adecuaci\u00f3n de la plantilla es la de los <strong>ERE temporales<\/strong>, regulados en el art\u00edculo 47, que establece que el empresario puede suspender el contrato de trabajo por causas econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n. El procedimiento se tiene que iniciar con una carta de la empresa a los representantes legales de los trabajadores en la cual se informe sobre la apertura de un periodo de consultas, explicando la causa del ERE temporal, los trabajadores afectados, la duraci\u00f3n y los criterios que se han utilizado para elegir a estos trabajadores, entre otros. Adem\u00e1s, se tendr\u00e1 que librar una copia de la carta a los trabajadores que resulten afectados por el ERE y a la autoridad
