su prevenci\u00f3n y para dar cama a las denuncias o reclamaciones que puedan formular quienes hayan estado objeto de este\u201d.<\/p>\n<p style=\"text-align: justify;\">Se trata de un protocolo obligatorio para todas las empresas, seg\u00fan la <strong>Ley de Igualdad<\/strong> 3\/2007, independientemente de su tama\u00f1o. No basta con tener el documento, sino que tiene que estar convenientemente implementado y difundido.<\/p>\n<p style=\"text-align: justify;\">El <strong>acoso sexual<\/strong> y el <strong>acoso por raz\u00f3n de sexo<\/strong> son faltas tipificadas como constitutivas de infracci\u00f3n muy grave en los apartados 12, 13 y 13 bis del arte. 8 de la LISOS y desde la Inspecci\u00f3n de Trabajo se est\u00e1n llevando a cabo intensas campa\u00f1as para la comprobaci\u00f3n que las empresas cuentan con estos mecanismos de actuaci\u00f3n en este La cual ya obligaba a las empresas el deber y mejorar las condiciones de trabajo. Esta Ley no es solo para reducir y prevenir los accidentes f\u00edsicos, sino tambi\u00e9n para los riesgos psicosociales.<\/p>\n<p style=\"text-align: justify;\">Esta Ley ha sido desarrollada normativamente y actualmente podemos destacar el Real decreto ley 6\/2019, de 1 de marzo, la Ley Org\u00e1nica 7\/2007 sobre la Igualdad de los hombres y mujeres y lo Real Decreto 901\/2020, de 13 de octubre, por el cual se regulan los planes de igualdad y su registro y se modifica el Real Decreto 713\/2010, de 28 de mayo, sobre registro y dep\u00f3sito de convenios y acuerdos colectivos de trabajo. Los cuales hacen especial menci\u00f3n, sobre el <strong>protocolo de acoso sexual<\/strong> y por raz\u00f3n de sexo. Por todo esto, la empresa (aunque tenga solo uno\/a trabajador\/a) tiene una serie de obligaciones, para la elaboraci\u00f3n de protocolos de conductas y actuaciones frente al acoso. Tanto laboral, como sexual y de cualquier forma de discriminaci\u00f3n en el trabajo.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfEs obligatorio que mi empresa disponga de un protocolo contra el acoso sexual y por raz\u00f3n de sexo?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">El <strong>protocolo contra el acoso sexual<\/strong>\u00a0y por raz\u00f3n de sexo, es obligatorio para todas las empresas sin importar el tama\u00f1o. La Ley Org\u00e1nica 3\/2007, en su Art\u00edculo 48 sobre medidas espec\u00edficas para prevenir el acoso sexual y por raz\u00f3n de sexo en el trabajo, establece \u00abLas empresas tendr\u00e1n que promover condiciones de trabajo que eviten el acoso sexual y el acoso por raz\u00f3n de sexo y arbitrar procedimientos espec\u00edficos para su prevenci\u00f3n y para dar cama a las denuncias o reclamaciones que puedan formular quienes hayan estado objeto de este\u00ab.<\/p>\n<p style=\"text-align: justify;\">El art\u00edculo 4, sobre <strong>Derechos Laborales<\/strong>, del <strong>Estatuto de los Trabajadores<\/strong> dice en la suya apartado e) \u00abAl respecto de su intimidad y a la consideraci\u00f3n debida a su dignidad, comprendida la protecci\u00f3n frente al acoso por raz\u00f3n de origen racial o \u00e9tnico, religi\u00f3n o convicciones, discapacidad, edad u orientaci\u00f3n sexual, y frente al acoso sexual y al acoso por raz\u00f3n de sexo.\u00ab<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfCu\u00e1l es el objetivo del protocolo contra el acoso sexual y acoso laboral?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">El objetivo de estas normativas y de las empresas, es de generar un ambiente que respete los <strong>derechos de los trabajadores y trabajadoras<\/strong>. Implantar un protocolo eficaz y conocido por todos los integrantes de las empresas, es de vital importancia para reducir los efectos generados por las situaciones no deseadas.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfTener un plan de actuaci\u00f3n es imprescindible para prevenir el acoso sexual?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Es importante tener un plan de actuaci\u00f3n que permita prevenir y detectar conductas no deseadas adecuados a los riesgos psicosociales. Adem\u00e1s de mejorar las condiciones laborales de nuestros empleados y que no se vea afectada negativamente la reputaci\u00f3n de la empresa. Con esto se conseguir\u00e1 una manera efectiva a las denuncias.<\/p>\n<p style=\"text-align: justify;\">En caso de que se produzca una presunta situaci\u00f3n de<strong> acoso labora<\/strong>l o <strong>acoso sexual<\/strong>. La persona afectada describir\u00e1 los hechos, fechas, presuntas acosadores, pruebas y testigos que han presentado la situaci\u00f3n. Cuanta m\u00e1s informaci\u00f3n facilite la persona afectada para esclarecer los hechos, m\u00e1s f\u00e1cil podr\u00e1 tomar la organizaci\u00f3n una adecuada decisi\u00f3n sobre este tema.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bbEstoy sufriendo acoso sexual en el trabajo, \u00bfqu\u00e9 puedo hacer?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Lo primero que tienes que hacer es acudir a la direcci\u00f3n de la empresa o recursos humanos, para comunicar por escrito y formalmente el que est\u00e1 ocurriendo.
