style=\"font-weight: 400;\">Ley org\u00e1nica 3\/2007, de 22 de marzo, para la igualdad efectiva entre mujeres y hombres<\/span><\/a><span style=\"font-weight: 400;\"> establece que las empresas est\u00e1n obligadas a respetar la igualdad de trato y de oportunidades en el \u00e1mbito laboral y, con cuyo objeto, tendr\u00e1n que adoptar medidas dirigidas a evitar cualquier tipo de discriminaci\u00f3n laboral entre mujeres y hombres.<\/span><\/p>\n<p style=\"text-align: justify;\">Con la aprobaci\u00f3n del Real Decreto 6\/2019, de 1 de marzo, y el m\u00e1s reciente <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2020-12214\" target=\"_blank\" rel=\"noopener\">Real Decreto 901\/2020<\/a>, todas aquellas organizaciones con m\u00e1s de 50 personas o m\u00e1s en plantilla tendr\u00e1n que contar por obligaci\u00f3n con un plan de igualdad.<\/p>\n<div class=\"traductor-textarea form-group\">\n<div class=\"textarea-desti col-xs-12 col-sm-6\">\n<div class=\"form-control second-textarea\">Tambi\u00e9n tienen que poner en marcha un Plan de Igualdad cuando as\u00ed lo establezca el convenio colectivo de aplicaci\u00f3n o cuando la autoridad laboral hubiera acordado en un procedimiento sancionador la sustituci\u00f3n de sanciones por la elaboraci\u00f3n y aplicaci\u00f3n de este plan.<\/div>\n<\/div>\n<\/div>\n<div class=\"traductor-checkbox form-group\">\n<div class=\"row\">\n<div class=\"col-sm-5\"><\/div>\n<\/div>\n<\/div>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfLas sociedades cooperativas est\u00e1n obligadas a elaborar planes de igualdad?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">S\u00ed, siempre que tengan personas trabajadoras por cuenta ajena y respecto de las mismas y en los supuestos previstos en el apartado anterior<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bbUna empresa con varios centros de trabajo dedicados a diferentes actividades y convenios colectivos de aplicaci\u00f3n diferentes, \u00bfCu\u00e1ntos planes de igualdad tiene que elaborar?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Un <strong>plan de igualdad<\/strong> \u00fanico y aplicable a toda la empresa, sin perjuicio que puedan establecerse en el mismo peculiaridades, as\u00ed como acciones especiales, para determinados centros de trabajo que respondan a sus especiales caracter\u00edsticas.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfQu\u00e9 materias contempla un plan de igualdad?\u00bb][vc_column_text]<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Proceso de selecci\u00f3n y contrataci\u00f3n.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Clasificaci\u00f3n profesional.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Formaci\u00f3n.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Promoci\u00f3n profesional.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Condiciones de trabajo, incluida la auditor\u00eda salarial.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Ejercicio corresponsable de los derechos de la vida personal, familiar y laboral.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Representaci\u00f3n femenina.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Retribuciones.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Prevenci\u00f3n del acoso sexual y acoso por raz\u00f3n de sexo.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bbEl personal becario u otras personas vinculadas con la empresa por relaciones no laborales, \u00bfcomputan como plantilla a efectos de la obligatoriedad de negociar el plan de igualdad?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">No. \u00danicamente computan como plantilla las personas trabajadoras por cuenta ajena para cumplir las notas previstas en el art\u00edculo 1.1 del Estatuto de los Trabajadores.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfTienen que computarse en la plantilla de la empresa usuaria, las personas cedidas por empresas de trabajo temporal?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">S\u00ed. Para el c\u00e1lculo del n\u00famero de personas que dan lugar a la obligaci\u00f3n de elaborar un <strong>Plan de Igualdad<\/strong>, se tendr\u00e1 en cuenta la plantilla total de la empresa, incluidas las personas cedidas en virtud de contratos de puesta a disposici\u00f3n.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bbLas empresas que no est\u00e9n obligadas a elaborar un Plan de Igualdad, pero que decidan elaborarlo de manera voluntaria, \u00bftienen que aplicar el procedimiento regulado en el art\u00edculo 5 del Real Decreto 901\/2020?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">El art\u00edculo 2.4 del Real Decreto 901\/2020 indica que los planes voluntarios tienen que ser consultados o negociados con la representaci\u00f3n legal de las personas trabajadoras si\u00e9ndolos aplicable lo regulado en este real decreto cuando as\u00ed resulte de su contenido. As\u00ed pues, en el supuesto de que sean negociados, el procedimiento de negociaci\u00f3n ser\u00e1 el que establece el art\u00edculo 5, que se refiere en todos los <strong>Planes de Igualdad<\/strong>, por lo cual tambi\u00e9n se aplica a los que tengan car\u00e1cter voluntario.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bbEn una empresa obligada a elaborar un Plan de Igualdad en la cual no existe representaci\u00f3n legal de las personas trabajadoras,\u00bf c\u00f3mo se compondr\u00e1 la parte social de la comisi\u00f3n negociadora?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Estar\u00e1 sujeta a las siguientes reglas (art\u00edculo 5.3, p\u00e1rrafo 1.\u00ba, del Real Decreto 901\/2020):<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\">Se compondr\u00e1 de un m\u00e1ximo de seis miembros.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Estar\u00e1 integrada por los sindicatos m\u00e1s representativos y por los sindicatos representativos del sector al cual pertenezca la empresa y con legitimaci\u00f3n para formar parte de la comisi\u00f3n negociadora del convenio colectivo de aplicaci\u00f3n.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">La representaci\u00f3n sindical se conformar\u00e1 en proporci\u00f3n a la representatividad de los sindicatos legitimados en el sector y garantizando la participaci\u00f3n de todos los sindicatos legitimados.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Sin embargo, esta comisi\u00f3n sindical estar\u00e1 v\u00e1lidamente integrada por aquella organizaci\u00f3n u organizaciones que respondan a la convocatoria de la empresa en el plazo de diez d\u00edas.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Por lo tanto, la distribuci\u00f3n de representantes en la comisi\u00f3n sindical de un m\u00e1ximo de 6 miembros se efectuar\u00e1 en proporci\u00f3n a la representatividad que tengan los sindicatos legitimados en el sector, siempre que se garantice la participaci\u00f3n de todos ellos.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfTiene que negociarse el diagn\u00f3stico previo y los Planes de Igualdad?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">S\u00ed, los <strong>planes de igualdad<\/strong>, incluidos los diagn\u00f3sticos previos, tendr\u00e1n que ser objeto de negociaci\u00f3n con la representaci\u00f3n legal de las personas trabajadoras a que se refiere el art\u00edculo 5 del Real Decreto 901\/2020.<\/p>\n<p style=\"text-align: justify;\">De no existir representaci\u00f3n legal de los trabajadores el Plan de Igualdad se tendr\u00e1 que negociar con los Sindicatos.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfCu\u00e1l es el contenido de los Planes de Igualdad?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Los <strong>Planes de Igualdad<\/strong> contendr\u00e1n un conjunto ordenado de medidas evaluables adoptadas despu\u00e9s de realizar un diagn\u00f3stico de situaci\u00f3n, tendentes a conseguir en la empresa la igualdad de trato y de oportunidades entre mujeres y hombres y a eliminar la discriminaci\u00f3n por raz\u00f3n de sexo.<\/p>\n<p style=\"text-align: justify;\">Tendr\u00e1n que tener el contenido m\u00ednimo previsto en el art\u00edculo 8.2 del Real Decreto 901\/2020.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfQu\u00e9 planes son objeto de registro obligatorio?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Todos los <strong>Planes de Igualdad<\/strong> que tengan tal consideraci\u00f3n (ve\u00e1is el apartado de planes voluntarios) ser\u00e1n objeto de inscripci\u00f3n obligatoria en el <strong>Registro de planes de igualdad<\/strong>, tanto si se trata de planes obligatorios como voluntarios, e independientemente de que hayan estado o no adoptados por acuerdo entre las
