<strong>Testamento<\/strong> es el acto jur\u00eddico voluntario en el cual una persona puede disponer del que se tiene que hacer despu\u00e9s de su muerte con todos sus bienes o parte de ellos. Un acto regulado por el sistema jur\u00eddico y legal. Hay una serie de premisas que se tienen que cumplir en la redacci\u00f3n del testamento.<\/p>\n<p>Es por eso, la importancia de estar asesorado convenientemente en la redacci\u00f3n de este. Por nuestra dilatada experiencia no hay dos testamentos iguales, y hay f\u00f3rmulas diferentes para cada caso.<\/p>\n<p>Hay diferentes modalidades de testamentos, los llamados \u201ctestamentos comunes\u201d, como por ejemplo, el testamento hol\u00f3grafo, el testamento abierto y el testamento cerrado. Y los \u201ctestamentos especiales\u201d, como serien; el testamento militar, el mar\u00edtimo o el testamento realizado en el extranjero.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfQu\u00e9 se tiene que hacer cuando una persona muere?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Cuando muere un familiar o tercero con el cual se tiene parentesco, es importante realizar una serie de pasos y tr\u00e1mites, como obtener el certificado de defunci\u00f3n en el Registro Civil, solicitar un certificado de \u00faltimas voluntades, realizar la participaci\u00f3n de la <strong>Herencia<\/strong>, pagar el <strong>Impuesto de Sucesiones<\/strong> y la <strong>Plusval\u00eda<\/strong>.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfC\u00f3mo s\u00e9 si existe Testamento?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">A veces nos asalta la duda \u201cdejar\u00eda hecho <strong>Testamento<\/strong>?\u201d. Para saberlo, se puede pedir el Certificado de Actas de \u00daltima Voluntad, un tr\u00e1mite que se tiene que hacer pasados 15 d\u00edas de la defunci\u00f3n y puede ser realizado por cualquier persona que aporte la documentaci\u00f3n requerida.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfQu\u00e9 pasa cuando no hay Testamento?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">En estos casos se abre la llamada <strong>sucesi\u00f3n<\/strong> \u201c<em>ab\u00a0intestato<\/em>\u201d, y es la ley del C\u00f3digo Civil la que establece la orden de la sucesi\u00f3n. En primer lugar los descendentes, hijos tanto biol\u00f3gicos como adoptados, tenidos dentro de la instituci\u00f3n del matrimonio como fuera de esta, nietos y bisnietos. En segundo lugar los ascendientes, es decir los padres. Despu\u00e9s le toca el turno al c\u00f3nyuge, sin testamento solo hereda en ausencia de los dos anteriores, aqu\u00ed reside parte de la vital importancia de hacer testamento. Siguen los hermanos, primos y en ausencia de todos el Estado.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfQu\u00e9 es la leg\u00edtima de Herencia?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">En el <strong>derecho de sucesiones<\/strong>, la <strong>leg\u00edtima<\/strong> es aquella cantidad de bienes que el muerto no puede disponer para estar reservada por ley a determinados <strong>herederos<\/strong>, denominados <strong>herederos forzosos <\/strong>o<strong> herederos leg\u00edtimo<\/strong>s. La leg\u00edtima tambi\u00e9n afecta indirectamente las transacciones entre personas vivas.<\/p>\n<p style=\"text-align: justify;\">La <strong>leg\u00edtima en Catalu\u00f1a<\/strong>, es la cuarta parte de la herencia a repartir entre todos los leg\u00edtimos, y puede realizarse en efectivo mediante la entrega de bienes que formen parte de la<strong> herencia<\/strong>. Y es el heredero o herederos los encargados de pagarla.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfQui\u00e9n tiene derecho a la leg\u00edtima?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">Son <strong>legitimarios<\/strong> todos los hijos del muerto por partes iguales. Si alguno de ellos muere antes de que el testador, es desheredado, declarado indigno o ausentes la parte de los cuales corresponde a sus descendentes.<br \/>\nSi el causante no tiene descendentes que lo hayan sobrevivido, son legitimarios los progenitores por mitad.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfPuedo renunciar a una Herencia?\u00bb][vc_column_text]Si, se puede renunciar a una <strong>Herencia<\/strong>, en la mayor\u00eda de casos porque el muerto ha dejado deudas, por lo cual no compensa heredar.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bbHerencia sin Testamento, \u00bfCu\u00e1les son los herederos legales?\u00bb][vc_column_text]Los <strong>herederos legales<\/strong> identificados por el C\u00f3digo Civil, son seg\u00fan el grado de parentesco con el muerto:<\/p>\n<ul>\n<li>los hijos del muerto, se reparten a partes iguales la <strong>herencia<\/strong>. Si alguno de ellos ha muerto, sus propios herederos ser\u00e1n a los cuales se los atribuya su parte.<\/li>\n<li>padres y el resto de ascendientes. En ausencia de hijos del causando los herederos son los padres. En caso de defunci\u00f3n de los padres, ser\u00edan los abuelos del causando los que hereden.<\/li>\n<li>el c\u00f3nyuge. Este es uno de los mayores problemas en ausencia de testamento.<\/li>\n<li>hermanos y sobrinos del causante. Estamos ante el \u00faltimo escal\u00f3n de la atribuci\u00f3n de herencia. Hablamos de los <strong>herederos colaterales<\/strong>.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00bb\u00bfPuedo aceptar la Herencia, pero no las deudas?\u00bb][vc_column_text]<\/p>\n<p style=\"text-align: justify;\">La <strong>aceptaci\u00f3n de la herencia<\/strong> puede ser simple, de forma que el heredero asume los bienes y tambi\u00e9n las deudas, que tendr\u00e1 que pagar con su propio patrimonio, si fuera necesario.
